Musing on legal aspects of the new EU digital VAT rules.

Bearing in mind I am nothing remotely approaching a lawyer, but as a reasonably well informed onlooker, I find myself pondering the following questions.

How long before the first court case over VATMOSS and the new digital EU VAT?

Should HMRC and HM Treasury be the ones explaining themselves in court?

  1. Hi,
Thanks so much for keeping at this and providing so much important information.
I have another question I ponder. As far as I know an EU citizen should not be disadvantaged in another EU country. (Sorry for not explaining this too well). So, if I, as a British micro business and an EU citizen have to pay VAT in say Germany when selling electronic services and I have to compete with a German micro business exempt from VAT selling electronic services in their own country, am I not unfairly disadvantaged and discriminated against?
